1. Who We Are

Tuneholic Entertainment is an artist management company based in Pune/Mumbai, India. We connect professional musicians with venues and coordinate live music bookings across India. Our platform at www.tuneholicentertainment.com/artist gives artists a personal dashboard to view gigs, track payouts, and manage their profile.

2. Eligibility

You may only use this platform if you:

• Are 18 years of age or older.
• Are a professional or semi-professional musician, performer, or artist seeking live music bookings.
• Have the legal capacity to enter into a binding agreement under the laws of India.
• Are registering on your own behalf, not on behalf of another person without their consent.

Minors (under 18) are strictly not permitted to register or use the platform.

3. Your Account

When you register at www.tuneholicentertainment.com/join, you create an account secured by a personal PIN. You are responsible for keeping your PIN confidential. Do not share your PIN with anyone. You are responsible for all activity that occurs under your account. If you suspect unauthorised access, contact us immediately at tuneholicindia@gmail.com.

4. What Tuneholic Does

Through the platform, Tuneholic will:

• Display your confirmed, upcoming, and past bookings on your artist dashboard.
• Send you notifications (via WhatsApp and push notifications, where you have enabled them) for new gig assignments, changes, and cancellations.
• Record and display your payout amounts for each performance.
• Allow you to mark dates as unavailable so we do not schedule conflicting gigs.

Tuneholic does not guarantee a minimum number of bookings, a specific income, or continuous availability of the platform. We reserve the right to modify or discontinue features with reasonable notice.

5. Your Obligations as an Artist

By using the platform, you agree to:

• Provide accurate and truthful information during registration and keep your profile updated.
• Honour confirmed bookings. Repeated last-minute cancellations may result in account suspension.
• Not use the platform for any unlawful purpose or in a way that could harm Tuneholic, venues, or other artists.
• Not attempt to reverse-engineer, scrape, or interfere with the platform's systems.
• Inform Tuneholic promptly if you are no longer available for new bookings.

6. Your Data Rights

Under India's Digital Personal Data Protection Act, 2023, you have rights to access, correct, and erase your personal data. You can exercise these rights directly through your artist portal or by contacting our Grievance Officer. For full details, please read our Privacy Policy at /privacy.

Note: Booking records (gig dates, venues, payment amounts) may be retained for up to 2 years after account deletion for GST and statutory audit compliance under Indian law.

7. Intellectual Property

All content, design, and code on this platform belong to Tuneholic Entertainment. You retain ownership of your own name, likeness, and artistic work. By registering, you grant Tuneholic a limited, non-exclusive licence to use your stage name and Instagram handle solely for the purpose of coordinating bookings and communicating with venues.

8. Account Termination

• By you: You may delete your account at any time using the "Delete Account" button in your portal settings. All personal profile data is deleted immediately.
• By Tuneholic: We may suspend or terminate your account if you breach these Terms, provide false information, engage in fraudulent activity, or if your account is inactive for an extended period. We will give reasonable notice except where immediate action is needed to protect the platform or other users.

9. Limitation of Liability

To the maximum extent permitted by Indian law, Tuneholic's liability to you for any claim arising from use of this platform is limited to the amounts actually paid to you by Tuneholic in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages, loss of income, or missed bookings caused by technical failures, third-party service outages, or events beyond our reasonable control.

10. Governing Law and Disputes

These Terms are governed by the laws of India. Any disputes arising from or related to these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts in Maharashtra, India. We encourage you to contact us first to resolve any dispute amicably before initiating legal proceedings.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you via WhatsApp or in-app notification at least 7 days before significant changes take effect. Continued use of the platform after that date means you accept the revised Terms.
